GENERAL TERMS AND CONDITIONS (GTC)

These General Terms and Conditions (GTC) apply to all contracts concluded between IMPIBAG e.U. and consumers as well as entrepreneurs via the IMPIBAG e.U. online shop and for purchases made on site (showroom and pop-up events).
Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to place an order. A purchase contract is only concluded upon our order confirmation by email or upon shipment of the goods.
We reserve the right to reject or cancel orders without stating reasons, in particular in the event of unavailability of the goods, technical errors, or obvious mistakes.
Products / Product Representation
We make every effort to present our products as accurately as possible. However, due to different screen settings, minor deviations in color and representation may occur. Such deviations do not constitute a defect.
Leather is a natural product. Natural characteristics such as grain, color nuances, or slight structural differences are inherent to the material and do not constitute a defect.
Prices
All prices include statutory value-added tax unless expressly stated otherwise. For deliveries to countries outside the European Union, invoices are issued net of VAT.
Additional customs duties, taxes, or import charges are to be borne by the customer.
Payment Terms
Payment of the purchase price is due before shipment of the goods. The available payment methods are displayed during the ordering process.
Delivery
Delivery is made to the countries specified in the online shop. Deliveries to additional countries are possible upon request.
The stated delivery times are to be understood as guideline estimates.
Right of Withdrawal & Cancellation (Online Purchases)
Consumers have the right to withdraw from the contract within 14 days of delivery without stating any reasons. The withdrawal period begins on the day on which the customer or a third party designated by the customer takes possession of the goods. Delivery is also deemed to have occurred if the shipment is deposited at a parcel shop or handed over to a third party designated by the customer (e.g. a neighbor), provided this occurs due to an unsuccessful delivery attempt at the specified delivery address.
The right of withdrawal does not apply to customized or personalized products, nor to sample items, exhibition pieces, or prototypes, insofar as these are not suitable for regular resale due to their specific nature and this circumstance was clearly communicated prior to the conclusion of the contract.
The withdrawal must be declared by email prior to returning the goods.
Returns must be sent to the following address:

The costs of return shipment are to be borne by the customer.
A direct exchange of items purchased online is not offered. After receipt and inspection of the returned goods, the refund will be issued using the same payment method that was used for the original transaction.
The right of withdrawal applies exclusively to consumers. Entrepreneurs are not entitled to a statutory right of withdrawal.
The withdrawal must be declared before returning the goods either by submitting the completed return form via email or via the return contact form on our website. After receipt of the withdrawal declaration, we will provide further return instructions. Goods may only be returned after these return instructions have been received. Returns sent without prior registration or without awaiting our return instructions will be considered improperly initiated and may not be accepted by us.
Returns that are sent without prior registration, without awaiting our return instructions, or outside the statutory withdrawal period may be rejected by us or returned to the customer at their expense.
Uncollected Shipments
If a shipment within the European Union is not collected and is returned to us, we reserve the right to charge handling and shipping costs of up to EUR 20.
For returns from countries outside the European Union, additional customs and shipping costs incurred may be invoiced.
Exclusion of the Right of Withdrawal

Purchases on Site (Showroom & Pop-up Events)
For purchases concluded on site in our showroom or at pop-up events, there is no statutory right of withdrawal or cancellation.
An exchange or return is excluded unless expressly agreed otherwise. Statutory warranty rights remain unaffected.
Retention of Title
The goods remain the property of IMPIBAG e.U. until full payment has been made.
Warranty & Liability
Statutory warranty provisions apply. No additional guarantees are provided. Claims for damages exist only to the extent mandated by law.
Order Quantities & Resale
We reserve the right to reject or cancel orders involving unusual quantities or where there are indications of commercial resale.
Technical Errors & Mistakes
Obvious typographical, printing, or calculation errors, in particular pricing errors, are reserved. In such cases, we reserve the right to withdraw from the contract or to offer a corrected invoice.
Contract Language
The contract language is German and English. In case of doubt, the German version shall prevail.
Applicable Law
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection regulations of the customer’s country of residence remain unaffected.
Place of Jurisdiction
To the extent legally permissible, the place of jurisdiction is Vienna.
